Sales from the 9th to the 29th of january

The following terms set the sales for products offered by SOLELUNE on its website at: www.modetrotter.com. SOLELUNE is a company with a capital of 20 000 €. It is based 29 rue du Faubourg Montmartre 75009 PARIS and registered at the Registre du Commerce et des Sociétés de Paris under siret number 50360626100017 Accepting the Sales terms and Conditions and clicking on “ order confirmation“ means that you have definitely confirmed your order.

SOLELUNE makes it impossible to sell a product without prior acceptance of the terms below.

ARTICLE 1

OBJET :
The present conditions aim to define the sales conditions between Modetrotter and clients, from orders to services, through payment and delivery. They apply to all the steps needed to pass an order and ensure that orders are followed through between the contracting parties.

aRTICLE 3

PRODUCT PRICES :
Prices are shown in Euro. They include French VAT, which is applicable on the day of order. If the VAT rate were to be modified, these changes would be applied to our product prices. Modetrotter reserves the right to change its prices at any time. Prices, however, cannot be modified once an order has been entered. Prices shown do not include freight charges, which will be added to the order and will be specified to the client on confirmation of the order. Delivery in Mainland France is effected with in an average of 2 to 5 days from reception of order by ModeTrotter, barring any act of God or any case of force majeure which may delay delivery irrespective of Modetrotter’s intention or diligence. Its cost varies according to the country of delivery and the means of transport selected. The products remain property of Modetrotter until the price has been paid in full.

ARTICLE 5

PAYMENT AND SECURED TRANSACTIONS :
The amount due by the client is the amount shown on the confirmation of order transmitted by e-mail par Modetrotter to the client. In order to guarantee secured payments, the Modetrotter website uses the secured payment service of La Société Générale. Confidential date (the 16-digit credit card number, expiration date and visual cryptogram) are directly transmitted in encrypted form to the payment platforms concerned, without any transit on the physical Mode Trotter server supports. Payment will be effected on the Internet on the www.modetrotter.com website, by credit card (Blue, Visa, Eurocard/Mastercard). In any case, Modetrotter reserves the right to turn down any order or delivery from a client we have a existing dispute with, or for total or partial non-payment of an order, or for a failed payment by credit card. Modetrotter’s responsibility will not in any way be claimed for such cases. When an order has been validated, the request for payment is sent in real time over the secured payment administrator, who asks for authorization from the credit card network. The remote payment administrator will deliver an electronic certificate.

ARTICLE 7

INTELLECTUAL PROPERTY :
All the elements of the Mode Trotter website, such as visuals, including the underlying technology, are protected by copiright, brands or patents. These are the exclusive property of www.modetrotter.com. The user who has a personal website and, for his/her own use, wishes to place a simple link on this site, directing users to Modetrotter, is under the obligation to first ask Modetrotter for permission to do so. On the other hand, any hypertext link directing users to the Modetrotter website and using for example the framing, deep-linking, or in-line linking technique or any other deep-link is strictly forbidden. In any case, any link –even if tacitly allowed, will have to be removed on simple request from Mode Trotter. Hypertext links may direct users to other sites than www.modetrotter.com. The latter denies any liability in case the content of these sites goes against the current law or regulations.

ARTICLE 8

LIBERTIES : NOMINAL INFORMATION :
For its own business needs, Modetrotter reserves the right to collect nominal information concerning users of the site, through cookies. The consumer acknowledges having been informed of this. To this purpose, the automatic use of information, including GESTION users’ e-mail addresses, has been registered with the CNIL under the number 1304809. In any case, and et corresponding to the law of 6 January 1978, the consumer also has the right to access and change any information about her/him that may feature in the SOLELUNE corporate files. Any client of the site can at any time object to the commercial use of the aforesaid data and has the right to access, change or cancel data about her/him, directly on the web via the Contact “HELLO” of the site.

ARTICLE 9

SIGNATURE AND PROOF :
In any case, providing a credit card number online and definitely validating the order will be evidence that the order has been thoroughly completed, as specified by the law of 13 March 2000 and will be l the payability of the sums engaged by the seizure of the items listed on the order form. This validation si like a signature of all the operations effected on the site. However, in case of fraudulous use of her/his credit card, the client is requested to contact the Mode Trotter customer service at 01 75 42 78 30 / hello@modetrotter.com, as soon as the fraud has been noted. The computer registers kept in the computer systems of the SOLELUNE company and its partners in reasonable security conditions, will be considered as evidence of the communication, orders and payment effected between users and Modetrotter. In any case, validating an order when payment is effected by credit card directly on the site means the order has been signed and all the operations effected on the site have been expressly accepted.

ARTICLE 10

CUSTOMS DUTIES :
Orders placed on the site and delivered outside France may be submitted to possible taxes and duties when the consignment reaches its final destination. These customs duties and possible taxes related to delivery are to be borne by the client, who is totally responsible for them. Modetrotter is not obligated to check and inform clients of applicable duties and taxes. To find this information, clients have to enquire with the relevant authorities of her/his country.

ARTICLE 11

INTEGRAL CONTRACT :
The present sales terms and the recapitulation of order sent to the client form a contractual set and constitute the complete contractual relations effected between the parties.

ARTICLE 2

PRODUCTS :
The objective of Modetrotter is to sell fashion apparel and accessories as available. The products are those featured for sale on the day the user has seen them on the website. If the product is not available, Modetrotter promises to warn the client by e-mail as early as possible. It the product has already been paid for, Modetrotter promises to refund the client for the price paid. The products for sale are described and presented with utmost accuracy. However, errors or omissions may be found in this presentation, for which Modetrotter cannot be held responsible. The photographs and texts illustrating the products are not included in this contract.

ARTICLE 4

REGISTERING AN ORDER :
Sales on www.modetrotter.com The client placing an order directly on the www.modetrotter.com website shall follow the following procedure: The client shall select the various products they are interested in and click on the « Add to shopping basket» link. They may at any time, either obtain a recap of the products selected by clicking on “My basket” or continue shopping by clicking on the “Continue shopping” link. The client will end her/his order by clicking on « Payment ». In order to properly validate an order, the client shall enter the following information: title, last name, first name, complete delivery / billing address, e-mail and phone number. They then specify the means of delivery they have selected -Colissimo or Chronopost. The order cannot be registered on the site unless the client has clearly identified her/himself with an e-mail address and a password which are strictly personal. Once the user has been identified, she/he shall validate the delivery address and an order form will be displayed showing a recap: items, quantity and price of the products selected by the user, as well as means of payment, address and telephone information and delivery address. Registering an order means accepting the price and the description of the products available for sale.

VALIDATING AN ORDER :
An order is validated once the user has read and approved the Sales terms and Conditions and once all the user information has been entered. The order is definite when the client has clicked on ‘”Validate”. Payment is effected by credit card only. The client enters her/his address, products and the total price of her/his order, freight included. . The client shall provide a credit card number and expiration date and the encrypted 3-digit figure on the back of the credit card. In any case, whatever means of payment, Modetrotter shall acknowledge reception of the order as soon as it has been validated by e-mail. 

ARTICLE 6

GUARANTEES :
All our products may be returned or exchanged, except when specified o therwise. Returns and refunds shall be requested within 10 days after reception or collection, and items exchanged or returned within this period must be sent back with the return form and the item in its original packaging to the following address: Mode Trotter/ 29 Rue du Faubourg Montmartre 75009 Paris - France. In addition, all document, references or contentions, all checks and all complementary payment must be sent to the Modetrotter Head Office - SOLELUNE 29 rue du Faubourg Montmartre 75009 Paris- France. It is necessary for the client to ask for a return sending an e-mail to hello@modetrotter.com so she/he can get a return authorization number; for trade-ins, the client will be sent a sign to stick on the package because Modetrotter pays for returns only in France. Modetrotter shall not accept returns of items that have been damaged but not reported by the client on delivery. To be accepted by Modetrotter, items and original packing must be returned in their original condition without having been worn or cleaned. Only items returned in their original packing (shoe boxes, plastic bags…) will be accepted. Consequently, items returned that have been worn and/or washed and damaged boxes will be refused . Modetrotter therefore reserves the right to accept or refuse the items returned according to its condition. All items are subject to a guarantee, which is in agreement with the legal guarantee of articles 1641 and next of Code Civil. The user will benefit from a guarantee for all items delivered with a flaw, as in articles L 211-4 and next of the Code de la Consommation.

Trade-ins :
All items from the www.modetrotter.com website may be traded in according to stock availability. You just have to mention the item you want to trade for when you ask for a trade-in. We will accept it on reception of your return, as far as stock is available. If the new order totals a higher price, the client will have to include the complementary payment to her/his return request. On the contrary, if the amount of the return costs less than the initial amount, the client will be sent credit for the price difference. To return an item, you only have to follow the instructions below: - Use the original packing to return the item. - Stick the label you will be sent by post so that Modetrotter can pay for postage ( only for France)Send your parcel to: Mode Trotter / 29 rue du Faubourg Montmartre 75009 Paris- France For Trade-ins in France -and trade-ins only- postage for the second consignment is free of charge. Please wait for the return label to arrive by post so you can stick it on your return consignment and so you do not pay for postage.

Refunds :
Refunds may also be requested within 10 days after your claim has been acknowledged, if you have purchased the item on the www.modetrotter.com website. Mode Trotter promises to refund clients within 30 days by credit card or by check as requested. If you wish to have a refund for an item, pleasecontact us hello@modetrotter.com; give your name, first name, telephone number and order number, and the reason for the return. Send back your parcel by post to the logistics centre of Mode trotter at: Mode Trotteur/29 rue du Faubourg Montmartre 75009 Paris -France Please note that we do not accept parcels sent postage due. Attention : You will be re-credited the amount of your purchase, minus contentious delivery charges. However the client will have to return the item in its original stage and packaging and sent back with the form included in the consignment, as evidence of the date it has been sent. In any case, all requests for returns or refunds will be sent by e-mail at hello@modetrotter.com. All items are under contract guarantee, which is in line with the legal guarantee of articles 1641 and next of the Code civil.

ARTICLE 12

DELIVERY :
The items are sent with the justifying invoice, to the delivery address given by the client upon ordering. All orders validated before 1pm are sent off that day, or the next working day. The delivery times shown are indicative from the day following that of validation of order by the client and match the processing and delivery times of these items. Under no circumstances will they be denied, but if a delay is unusual, an e-mail will be sent to the client. Modetrotter therefore denies any responsibility in case delivery times are too long because of the postal services or because items ordered have been lost or in case of a strike. Transportation risks are borne by the client, who will have to write out a specific complaint to the Post or the carrier, within 3 days of delivery. It may however happen that an item will be missing, even though Modetrotter has paid the closest attention to the preparation of the parcels. Similarly, after the parcels has been carried, an item may be defective. Thais is why, upon reception of order, the client will have to check the items received are right. Any wrong due to delivery (missing or broken item, damaged parcel) will necessarily be notified, on the very day of delivery or the first working day after delivery, with the Mode Trotter Customer Service, by certified mail (addressed to SOLELUNE/modetrotter - Service Client – 29 rue du Faubourg Montmartre 75009 Paris). Complaints expressed after this period will be rejected and SOLELUNE will be free of any responsibility. SOLELUNE reserves the possibility of asking the client to return the defective item. If the conditions mentioned above are met, ModetTrotter will then trade in or refund defective items or send the missing item (provided the buyer has proved her/his request is acceptable).

DELIVERY TIMES AND COSTS :
The times shown are indications of times given by our carriers over working days. Standard = the Poste (colissimo suivi. Handed over with a signature). Express= chronopost, handed over with a signature All the items presented on the site correspond to our actual immediate capacity. All the orders validated before 1.00 pm will be sent off that day, or the next working day. You will receive an confirmation e-mail when the parcel is sent off. From then, the carriers times mentioned below have to be remembered. Over about 100 euro’ purchases, ModeTrotter advises you to choose Colissimo with insurance. All prices are in euro.

COLISSIMO DELIVERY :
The Colissimo suivi is delivered by La Poste within 2 to 5 working days (for mainland France). It is delivered to the delivery address shown on your order form against your signature. If you are not at home, the postman will leave a notice saying when and how you may get your parcel (location and details). You generally have 2 weeks to claim your parcel. You can follow up your parcel on the www.coliposte.net website, from the Colissimo number shown in the “my account” signet. If you have not received your parcel after 5 days and no notice has been left at your home, please check the state of your parcel on the Coliposte site and contact us by e-mail, phone or email to hello@modetrotter.com. Damaged parcels : We ask of you not to acknowledge reception of damaged parcels (bow bearing visible signs of having been opened or damages) : you must not accept the parcel. Indeed, parcels leaving the Modetrotter warehouses are always faultless and must delivered that way. If a damaged parcel has been left in your mailbox or if a concierge has taken it in, the parcel is considered to have been “accepted as such”. Unless a reserve has been expressed, we will not be able to take into account any possible loss or proceed to any payment. Your order You may follow up in real time the itinerary of your order on your client account. Here are the 2 states of an order: "in waiting" Your order is waiting to be prepared. In case of a problem, please feel free to contact our customer service at 01 75 42 78 30 / hello@modetrotter.com. "sent off" Your parcel has left our warehouses and it is being delivered. You can follow it up on the carrier’s website. Parcels handled by La Poste may be followed up, as they are each allotted a unique number. You may follow up your delivery at http://www.coliposte.net, in the «Particulier » part, entering the number you will find on the e-mail informing you of the date you parcel has left our warehouses.

DELIVERY PROBLEMS :
Colissimo suivi: If you are not home, a notice will be left in your mailbox. Your parcel will be available for 2 weeks at the Post Office.
