The following provisions establish the general conditions of sale of the products offered by SOLELUNE on its website www.modetrotter.com. SOLELUNE is a company with capital of €58,892.40, with registered office at 28 rue d'Aboukir 75002 Paris, registered in the Paris Trade and Companies Register under SIRET (unique establishment) number 50360626100017. By accepting the General Conditions of Sale and clicking on “Confirm your order” you definitively confirm your order.
It is not possible to purchase a product from SOLELUNE without first accepting the clauses set out below.
The purpose of these conditions is to set out the terms and conditions of sale between Modetrotter and the customer, from ordering, through payment and delivery, to services. They govern all the steps necessary to place the order and ensure tracking of the order between the contracting parties.
ModeTrotter offers for sale articles of clothing and fashion accessories, subject to available stocks. The products are those appearing for sale on the day of consultation by the user. If products are unavailable, this is displayed on the website, failing which, in the event of error, Modetrotter undertakes to advise the customer by email as soon as possible. Modetrotter undertakes to refund the price of the item to the customer if the product has already been paid for. Products offered for sale are described and presented as accurately as possible. Modetrotter cannot, however, be held liable for any error or omission in the description or presentation. Photographs and text illustrating the products do not fall within the scope of the sales contract.
PRICES OF THE PRODUCTS:
Prices are given in Euros. They include French VAT at the rate applicable on the day the order is placed. Any changes in the VAT rate will be reflected in the price of the items. Modetrotter [PM1] reserves the right to alter its prices at any time. Prices cannot, however, be changed once an order has been confirmed. The prices indicated do not include shipping costs, which will be added to the total cost of the order and will be advised to the customer when the customer confirms the order. Items will be delivered in metropolitan France within an average of 2 to 5 days following receipt of the order by ModeTrotter, without prejudice to any fortuitous event or event of force majeure beyond Modetrotter’s control which may delay delivery. The cost of shipping products will depend on the country in which they are to be delivered and the method of transport chosen. The products remain the property of ModeTrotter until the price has been paid in full.
The procedure for placing an order directly on the www.modetrotter.com website is as follows: The customer must first create a customer account. The customer then chooses the different products in which he or she is interested and then clicks on the link “Add to my basket”. The customer can at any time either see a summary of the selected products by clicking on “My basket” or continue purchasing. The customer completes the order by clicking on “Payment”. In order to confirm the order correctly, the customer must complete the following fields: title, surname, forename, full delivery/billing address, email and telephone number. The customer then specifies the method of delivery selected (DHL/Colissimo /Chronopost/collection from the showroom). The order can only be registered on the website if the customer has clearly identified him or herself by entering his or her email address and a password, which are strictly personal. Once the user has been identified, they must confirm the delivery address and then a purchase order will appear summarising the following: the nature, quantities and prices of the products selected by the user, the payment method chosen, the user’s personal details and the delivery address for the package. Any order constitutes acceptance of the prices and descriptions of the products available for sale.
CONFIRMATION OF THE ORDER:
The order is confirmed once the General Conditions of Sale have been read and accepted and all the fields have been completed by the customer. The order is final when the customer clicks on “confirm”. Payments can only be made by bank card. The customer confirms his or her address, the product(s) and the total price of the order, including shipping costs. The customer must provide the bank card number, the expiry date of the card and the card verification number (three-digit number appearing on the back of the bank card). In all cases, whatever the method of payment chosen by the customer, Modetrotter will acknowledge receipt of the order by email as soon as it is confirmed.
PAYMENT AND SECURITY OF TRANSACTIONS:
The amount due from the customer is the amount indicated in Modetrotter’s order confirmation. The Modetrotter.com website uses Société Générale’s secure payment service to ensure payments are secure. The confidential data (16 digit bank card number, expiry date and card verification number) are encrypted and transmitted direct to the relevant payment platforms without passing over the physical media of modetrotter’s server. Payments are made on the website www.modetrotter.com by bank card (Carte Bleue, Visa, Eurocard/Mastercard). Modetrotter reserves the right to refuse any order or any delivery in the event of an existing dispute with the customer, full or partial non-payment of an order, a rejected card payment or for other reasons which Modetrotter reserves the right to explain to its customer. Under no circumstances may Modetrotter be held liable in this regard. If the order is confirmed, the request for payment is routed in real time to the secure electronic payments manager, which sends an authorisation request to the card network. The electronic payments manager delivers an electronic certificate.
All products can be exchanged or refunded except where specified to the contrary. The exchange or refund must take place within the 14 says following the date of receipt and items must be returned in their packaging within that period together with the original invoice, to the following address: Modetrotter/ 28 bis rue d'Aboukir, 75002 Paris.
NB: for items collected from the showroom, no refund is possible once 14 days have passed from the date of notification of availability for collection.
It is essential that the customer sends an email (email@example.com) requesting to return an item, to enable Modetrotter to approve the request. Modetrotter covers the costs of returning items for exchange, but only for France. Modetrotter will refuse any damaged item [PM2] in the absence of express reservations or observations by the customer at the time of delivery. Modetrotter will only accept items and the original packaging if they are returned in their original condition and have not been worn or washed. Only items returned in their original packaging (shoe box, plastic sleeves, etc.) will be accepted. Consequently, returns of clothes that have been washed and/or worn and damaged boxes will be rejected. ModeTrotter reserves the right to accept or refuse returned items depending on their condition. All items are covered by a contractual guarantee, which does not affect the legal guarantee under articles 1641 and following of the French Civil Code. Pursuant to articles L 211-4 and following of the French Consumer Code, users benefit from a guarantee under which they can return items delivered in a defective condition.
All items on the site www.modetrotter.com website may be exchanged subject to stock availability. All you need to do is state the item you would like to receive in exchange when you send your return request. We will agree this upon receipt of your returned item, subject to availability. If the price of the new order is higher than that of the original order, you will need to enclose a cheque in payment of the balance with your request to exchange. If, on the other hand, the price of the exchange item is lower than the original price, the difference will be refunded direct to your bank card. To return an item, you simply need to follow these instructions:
- Send an email to “firstname.lastname@example.org” to enable Modetrotter to approve the return.
- Use the original packaging to return the product.
- Send your package to the following address: Modetrotter, 28 bis rue d'Aboukir, 75002 Paris. For an exchange in metropolitan France (and only for an exchange), the shipping costs of the second delivery will be paid for you.
You may also request a refund within the 14 days following the date of receipt of your package, if the purchase was made on the www.modetrotter.com website, ModeTrotter undertakes to refund you within a maximum period of 30 days either by refund to your bank card or by cheque, at your choice. If you would like a refund for your item, please email “email@example.com”. State your surname, forename, telephone number, order number and why you are returning the item. Return the package by post to Modetrotter’s logistics centre at the following address: Modetrotter, 28 bis rue d'Aboukir, 75002 Paris.
Please note that we do not accept packages sent carriage forward. NB: You will be recredited with the amount of your order, less the original shipping costs. You must, however, return the item as-is in its original packaging and the article must [PM3] be returned with Modetrotter’s authorisation and its return number included in the package as proof of the date of this remittance. Any request for exchange or refund must, in all cases, by made by email (heading: “hello”). All items are covered by a contractual guarantee, which does not affect the legal guarantee under articles 1641 and following of the French Civil Code.
N.B. during private sales, sales or clearance sales items are taken back in exchange for another item or a credit note only and, in this instance, the shipping costs are not paid by Modetrotter.
All elements of the Modetrotter site, such as the visuals, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of www.modetrotter.com. A user who has a website for personal use and wishes to place on that website a simple link direct to the Modetrotter website for personal use must request Modetrotter’s permission before doing so. In addition, any hypertext link to the Modetrotter website that uses framing, deep-linking, in-line linking or any other deep-linking technique is formally prohibited in any circumstances. In all cases, any link, even one that has been tacitly authorised, must be removed upon a simple request from ModeTrotter. Hypertext links may link to websites other than www.modetrotter.com. The latter does not accept any liability if the content of such websites contravenes current laws or regulations.
INFORMATION TECHNOLOGY AND FREEDOMS:
Modetrotter reserves the right, for the purposes of its business activity, to collect personal data relating to users of the website, including through “cookies”. The consumer acknowledges that he or she is aware of this. Accordingly, the automated processing of information, including the management of users’ email addresses, was the subject of a declaration to the French Committee on Information Technology and Freedoms (CNIL) under number 1304809. In any event, and in accordance with the French act of 6 January 1978, consumers also have a right to access and rectify any of their information held in SOLELUNE’s files. Any customer of the website may, at any time, object to the commercial use of the aforementioned data and also has the right to access, rectify and delete his or her data, directly on the Internet or through the website’s contact area.
SIGNATURE AND PROOF:
In all cases, the online provision of the bank card number and final confirmation of the order constitute proof of the entirety of the order in accordance with the provisions of the French act of 13 March 2000 and render payable the sums incurred as a result of entering the items appearing on the purchase order. This confirmation constitutes signature and express acceptance of all transactions effected on the website. Nevertheless, if a customer’s bank card is used fraudulently, the customer is invited to contact ModeTrotter’s customer service department on 01 75 42 78 30 as soon as he or she becomes aware of such use. The computerised records, held on the computer systems of SOLELUNE and its partners in reasonable conditions of security, will be deemed to be proof of the communications, orders and payments between the parties. In any case, when payment is made by bank card directly on the website, confirmation of the order constitutes signature and express acceptance of all transactions effected on the website.
Any order placed on the website and delivered outside France may be subject to tax and customs duties charged when the package reaches its destination. Such customs duties and taxes associated with delivery of an item are the responsibility of and payable by the customer. Modetrotter is not obliged to check and inform its customers of the applicable customs duties and taxes. It is the responsibility of members to obtain this information from the relevant authorities in their countries.
Disputes/Governing [PM4] Law:
The language of these general conditions of sale is French. This contract is subject to French law. The French courts will have sole jurisdiction in the event of any dispute with a customer.
These general conditions of sale and the order summary sent to the customer form a contractual whole and constitute the entirety of the contractual relations between the parties.
The products are shipped, with the supporting invoice, to the delivery address indicated by the customer when placing the order. All orders confirmed before 13.00 are shipped the same day; orders confirmed after that time are shipped the following business day. The delivery periods quoted are indicative periods starting on the day following the day on which the customer confirms the order and are the periods for processing and delivery of the products. They are not binding or enforceable under any circumstances. However, in the event of an unusually long delay you will be sent an email. Modetrotter does not accept any liability for an excessive delay in delivery attributable to the postal services or means of transport or in the event of loss of the products ordered or strike action. Transport risks are borne by the customer, who must submit a reasoned complaint to the postal services or the carrier, within the three business days following delivery. It is possible that there may be missing items despite the care paid by Modetrotter in preparing the packages. Similarly, following transport of the package, one of the products could prove to be defective. That is why, upon receipt of the order, the customer must check that all the products are present and in good condition. Any problem with the delivery (missing or broken product, damaged packaging) must be notified to Modetrotter’s customer service department on the day of receipt or on the first business day following receipt, by registered mail (addressed to Modetrotter- Service Client – 28 bis rue d'Aboukir, 75002 Paris). Customers can follow the delivery status of their packages under “My Account”. Any complaint made after this time will be rejected and Modetrotter will be released from any liability. Modetrotter reserves the right to ask the customer to return the defective product to it. If the aforementioned conditions are satisfied, Modetrotter will then exchange or refund the defective product(s) or reship the missing product (provided the Purchaser’s request is justified).
DELIVERY TIMES AND CHARGES:
The times indicated are our carriers’ indicative delivery times in business days. Standard = French postal service (Colissimo suivi). Express = Chronopost signed-for. All the products shown on the website are items actually and immediately available. All prices are in Euros. Packages sent by Colissimo suivi are delivered by the postal service within 2 to 5 business days (for metropolitan France). The package is delivered to the address indicated on your purchase order. If you are not in, the postman or woman will leave you an attempted delivery note (avis de passage) informing you how you can collect your package (place and times). Your package will generally be held available for you to collect for 15 days. You can follow the progress of your item on the website www.coliposte.net. If you would like to receive your Colissimo number, please send an email to firstname.lastname@example.org stating your surname and forename. If you have not received your Colissimo suivi package after 5 days and no attempted delivery note has been left for you, you should consider checking the status of your package on the coliposte website (and contact us by email at email@example.com). Damaged package: we ask you not to accept a damaged package (box bearing visible traces of damage and/or of having been opened); you must refuse to accept it. Packages are always in perfect condition when they leave our warehouses and must be delivered to you in that condition. If a damaged package has been placed in your letter box or your concierge has accepted it, the package is deemed to be “accepted as is”. If no reservation has been raised, we will not be able to take account of any missing items or pay any compensation.
